Some disputes and disagreements involve two parties and in others more, in many cases, there are also other stakeholders such as insurers or funders.  Whatever the nature of the disagreement or dispute and the number of parties and potential stakeholders involved, also whether or not it has reached the stage of legal or arbitration proceedings, Clive’s aim is to work with all relevant parties to help find practical and workable solutions through facilitated discussion and principled negotiation.

Clive is an accredited mediator and a member of the Civil Mediation Council.  He is also a Solicitor with over 35 years’ legal experience working in companies and law firms specialising in commercial and property legal work.  Relevant to his mediation work, Clive has participated in a Harvard Law School Program on Negotiation Executive Education course (PON Global).

Clive is confident to mediate most types of disputes and disagreements, including community disputes, but given his background as a Solicitor specialising over many years in commercial and property legal work, he feels particularly comfortable - and can provide real added value - to ones involving commercial or property issues.

Mediations conducted by Clive involve active listening to understand each party’s concerns and needs (the subjective as well as the objective), exploring possible options to address underlying interests that potentially go beyond the subject matter of a particular dispute and the parties’ respective positions on it, clarifying communications to avoid misunderstandings, looking for common ground and helping to find and finalise pragmatic solutions that allow the parties to move on.

Sometimes it can be difficult getting the other party or parties involved to agree to mediation.  In situations like these Clive will, when appropriate, approach the other party or parties to help persuade them to consider mediation.
